1. Agreement to Terms
By accessing or using SilentBoom's services, website, or any related applications, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access our services.
2. Services Description
SilentBoom provides technology solutions including but not limited to:
- Website and web application development
- Mobile application development
- MVP (Minimum Viable Product) development
- AI-powered advertising management
- Website optimization and repair services
- Technical consulting and support
3. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your project
- Respond to our inquiries within reasonable timeframes
- Provide necessary access, content, and approvals for project completion
- Pay all fees as outlined in your project agreement
- Use our services in compliance with all applicable laws
4. Payments and Fees
All project fees are outlined in your specific project agreement. We offer:
- Fixed-price quotes (no hidden costs)
- Milestone-based payment structures
- Monthly retainer options for ongoing support
Payments are due according to the schedule in your agreement. Late payments may result in project delays.
5. Intellectual Property
Upon full payment, all custom-developed code and deliverables become your property. However, we retain the right to use any reusable components, libraries, or frameworks developed during your project for future work, unless otherwise agreed in writing.
Any third-party software, assets, or APIs used in your project remain the property of their respective owners.
6. Project Timeline and Delivery
Estimated timelines are provided in good faith but may be affected by client response times, changing requirements, or unforeseen technical challenges. We will communicate any delays promptly.
You have 14 days to review and accept deliverables. After that, deliverables are considered accepted.
7. Refund Policy
Our refund policy is detailed in our Refund Policy. Generally, deposits for started work are non-refundable. Completed milestones are billed as completed.
8. Limitation of Liability
To the maximum extent permitted by law, SilentBoom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of our services.
Our total liability shall not exceed the total amount paid by you for our services in the 6 months preceding the claim.
9. Termination
Either party may terminate a project agreement with written notice. Upon termination:
- You pay for all completed work up to termination date
- We deliver all completed deliverables
- Unused prepaid amounts may be refunded
10. Governing Law
These terms shall be governed by the laws of India, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delhi, India.
11. Changes to Terms
We reserve the right to modify these terms at any time. We will notify clients of material changes via email or through our website. Continued use of our services constitutes acceptance of updated terms.
